This Settlement Agreement and Release (“Settlement Agreement”) is entered into by and between (i) Forward Bank (“Forward Bank” or “Defendant”) and (ii) Kimberly Broeske, Matthew Hamilton, and Ethan Rohland (collectively, “Plaintiffs”), in the case of Broeske, et al., v. Forward Bank, Case No. 2024CV000006, Wood County. Defendant and Plaintiffs are collectively referred to herein as the “Parties” or “Settling Parties”. The lawsuit is referred to herein as the “Litigation.” The Settlement Agreement is subject to Court approval and intended by the Settling Parties to resolve, discharge, and settle the Released Claims and this Litigation (as defined below), upon and subject to the terms and conditions set forth below.
