Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order R7-2017-0005 (Settlement Order) alleges the Discharger violated NPDES No.CA0104451 on multiple occasions. As identified in Exhibit B, the Discharger has committed thirty-five (35) Non- Mandatory Minimum Penalty (Non-MMP) violations of Waste Discharge Requirements (WDRs) Orders R7-2003-0049 and R7-2008-0020 subject to discretionary penalties. Additionally, Paragraph 29 of the Settlement Order indicates that the Discharger also violated the specific milestones set forth in Cease and Desist Order (CDO) R7-2009-0007. Further, as indicated in Paragraph 31 of the Settlement Order, the Discharger has been in violation of CDO R7-2012-0024 since February 28, 2014. All of these violations are subject to discretionary penalties. However, for the reason stated in Paragraph 30 of the Settlement Order, the Prosecution Team is not seeking discretionary penalties for the violations of CDO R7-2009-0007. In sum, the P
