THIS HOURLY FEE AGREEMENT, effective this 15th day of October, 2020, is made by and between the law firm of BURG SIMPSON ELDREDGE HERSH & JARDINE, P.C., 8310 South Valley Highway, Suite 270, Englewood, Colorado 80112 (“Attorneys”), and Passage Point Condominium Association, Inc. (the “Client”). At the request of Client, Attorneys have agreed to represent Client in connection with roof construction defect issues at the Passage Point Condominiums located at 910 Copper Road, Copper Mountain, Colorado 80443, on the following terms and conditions with respect to attorneys’ fees and out-of-pocket disbursements to be incurred:
