ACCEPTANCE AND AGREEMENT – This order becomes a binding contract on the terms and conditions set forth herein when accepted by Seller either by acknowledgement or commencement of performance. No modification hereof and no condition stated by the Seller in accepting or acknowledging this order which is in conflict or inconsistent with or in addition to terms and conditions set forth herein shall be binding upon Buyer unless accepted in writing. Further, no agreement or understanding, verbal or otherwise, shall be or become a part hereof unless agreed to in writing by Buyer’s authorized representative.
