According to the provisions of the Civil Code Article 1313, it states that "Agreement is an act by which one or more persons bind themselves to one or more other persons. A loan- receivable agreement is included in the type of loan agreement, that the latter party will return an amount of the same kind and this is as regulated and determined in Article 1754 of the Civil Code which clearly states: That a loan agreement is an agreement whereby one party gives to the other a certain amount of goods which are exhausted due to use, with the conditions are the same.
