This Continuing Disclosure Agreement (the "Agreement"), dated as of 1, 2022, is executed and delivered by the Texas Department of Housing and Community Affairs (the "Department") and The Bank of New York Trust Mellon Company, N.A., as Trustee (the “Trustee”), in connection with the issuance of the Department's Single Family Mortgage Revenue Bonds, 2022 Series A (the “Series 2022 Bonds”). The Series 2022 Bonds are being issued pursuant to an Amended and Restated Single Family Mortgage Revenue Bond Trust Indenture, dated as of June 1, 2017 (as amended and supplemented from time to time, the “Trust Indenture”), between the Department and The Bank of New York Mellon Trust Company, N.A., as Trustee, Paying Agent, and Registrar for the Series 2022 Bonds issued by the Department thereunder.
