This INFRASTRUCTURE AGREEMENT (the “Agreement”) is made and entered into this day of , 2015 (the “Effective Date”), by and between the CITY OF DUBLIN, OHIO (the “City”), a municipal corporation duly organized and validly existing under the Constitution and laws of the State of Ohio (the “State”) and its Charter, and CASTO TULLER LLC (“Developer” and together with the City, the “Parties”), an Ohio limited liability company, under the circumstances summarized in the following recitals (the capitalized terms not defined in the recitals are being used therein as defined in Article I).
