This Construction Management Services “At Risk” Agreement (“Agreement”) is entered into this eighteenth day of February 2022, by and between the SOUTHWESTERN COMMUNITY COLLEGE DISTRICT, referred to in this Agreement as “the Owner,” and, RUDOLPH AND SLETTEN, INC. as Construction Manager at Risk, referred to in this Agreement as “the “CM” or “CMR” to be used interchangeably. The Owner and the CMR are also referred to in this Agreement, collectively as “the Parties” and individually as “Party.” This Agreement is entered into with reference to the following recitals, all of which are incorporated herein by this reference.
