These Terms and Conditions shall apply to all instances of the sale, provision, or rental of goods, materials, wares, merchandise, supplies, personalty, and equipment of all types and descriptions (individually or collectively, as context so requires, “Goods”) and/or the provision of services (the “Services”) by Bison Drilling and Field Services LLC and/or Bison Trucking LLC, as applicable, (hereinafter, “Bison”) to the party receiving the same (“CUSTOMER”). Bison shall not be deemed to have waived these Terms and Conditions if it fails to object to provisions appearing on, incorporated by reference in, or attached to CUSTOMER’s purchase order, request for proposal, bid sheet, field ticket, terms and conditions, work order form, or any other materials, documents or communications from CUSTOMER.
