Contract Type FiledMay 5th, 2020This matter was initiated by a complaint filed under title II of the Americans with Disabilities Act of 1990 ("ADA"), 42 U.S.C. §§ 12131-12134, with the United States Department of Justice ("Department") against the City of New Albany, Indiana ("City"). The complaint was received by the Disability Rights Section ("DRS") of the Civil Rights Division of the Department of Justice, under the authority of 28 C.F.R. Part 35, Subpart F. The complainant alleged that the City Departments of New Albany were inaccessible to persons with disabilities and that there was no TTY equipment to communicate with hearing or speech impaired individuals. The complaint also alleged that the City did not have a transition plan. Because the City receives financial assistance from the Department of Justice, our review was also conducted under the authority of § 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794, and the Department's implementing regulation, 28 C. F.R. Part 42, Subpart G.
