This Merchant Card Processing Agreement is for merchant card payment processing services between the merchant (“Merchant”) that signed the Application (the “Application”) and Synovus Bank (the “Merchant Bank”) and CardConnect, LLC (the “Processor”). The Processor and the Merchant Bank are collectively hereinafter referred to as the “Bank”. Processor and Merchant Bank reserve the right to allocate Bank’s duties and obligations amongst themselves as they deem appropriate in their sole discretion, and Merchant Bank or Processor may jointly or individually assert or exercise any rights or remedies provided to Bank hereunder.
