SETTLEMENT AGREEMENT TERM SHEETSettlement Agreement • September 17th, 2020
This Agreement is made by Libbey Glass Inc. (the “Company”), United Steel, Paper and Forestry, Rubber, Manufacturing and Energy, Allied Industrial and Service Workers International Union and International Association of Machinists and Aerospace Workers Lodge 105 (the “Union” or “USW” or “IAM”); (together the “parties”). Each of the Union parties to this Settlement Agreement enters into the agreement as the bargaining agent of certain of the Company’s employees and as the authorized representative for purposes of Section 1114 of the Bankruptcy Code of the retirees, surviving spouses, and other dependents receiving retiree benefits pursuant to collective bargaining agreement between the Company and the Union. The Company reserves the right to modify this proposal, in whole or in part. This proposal is a package, all parts contingent on the others. A rejection of any part of this package proposal is a rejection of the whole package.
