The Division of Oil, Gas and Mining (Division) and the Manti-La Sal National Forest (Forest Service) accept the Conditional Approval Agreement (Agreement) for the Levan Chicken Creek Mine. A copy of this agreement is included with this letter. It shows areas where the Division and Forest Service approve mining operations and special conditions under which the operations are to be conducted pending complete approval. You are now permitted to conduct operations as outlined in the approved Notice of Intention to Commence Large Mining Operations (Notice) and the Agreement provided you have approval from all other appropriate agencies. The conditional approval or acceptance of a Notice does not relieve an operator from his responsibility to comply with the applicable statutes, rules, regulations, and ordinances of all local, state and federal agencies with jurisdiction over any aspect of the operator's mining operations.
