Terms & Conditions 1. OFFER TO SELL.Seller, HydraForce Hydraulics Ltda. (“Hydraforce”) hereby offers to sell to the party or parties noted on the front of this document as Buyer, the products described on the face of this offer on the terms and conditions stated herein. Acceptance of this offer is expressly limited to acceptance of all the terms and conditions of this offer. No additional terms contained in any document tendered by Buyer and no oral terms shall become a part of the agreement between the parties. 2. SHIPMENT.The Parties recognize that in the absence of express, written agreement to the contrary, all purchases of the products by Buyer shall be on an FCA basis from HydraForce’s factory or warehouse, as that term is defined in Incoterms 2010. Title to the products shall pass to Buyer upon delivery FCA. For avoidance of doubt the parties understand that the term FCA shall mean the goods are made available for pickup at the relevant HydraForce factory or warehouse, cleared
