This Settlement Agreement and Release (“Agreement”) is between Jay Sherrard and Dolly West (“Plaintiffs” or “Class Representatives”), individually and on behalf of the Settlement Class (as defined in § 1.18 below), and American Credit Acceptance, LLC (“ACA”). This Agreement provides for settlement of the claims against ACA in the action entitled Jay Sherrard, et al. v. American Credit Acceptance, LLC, Los Angeles County Superior Court Case No. 19STCV43101 (“Action”), and the arbitration entitled Sherrard, Jay, et al. v. American Credit Acceptance, LLC, JAMS Ref. No. 1220065564 (“Arbitration”), and it is subject to approval by the Court (as defined in § 1.6 below).
