This Settlement Agreement and Release (the “Agreement”) is entered into by and among plaintiff Cesar E. Cortes (“Named Plaintiff”) and all those on whose behalf he is prosecuting this action (each of them a “Plaintiff” and all of them “Plaintiffs”), on the one hand, and defendant BluPeak Credit Union (FKA University & State Employees Credit Union and referred to herein as “Defendant”), on the other hand, as of the date executed below. All references in this Agreement to a “party” or the “parties” shall refer to a party or the parties to this Agreement.
