This Class Action Settlement Agreement and Release (“Agreement”) is made and entered into as of this day of August 2022, by Timothy Goodrich, Nolte Mehnert, George T. Farmer, Erik Ernstrom, W. Walter Layman, Bradley Briar, and Keri Reid (“Plaintiffs”), on behalf of themselves and the Settlement Class, as defined below, and Defendants Alterra Mountain Company, Alterra Mountain Company U.S. Inc., and Ikon Pass Inc. (together, “Alterra”), to settle, fully and finally, all of the claims that have been or could have been brought in the 12 consolidated putative class-action lawsuits (defined in Section I(A) below) against Alterra relating to 2019/20 Ikon passes, as described below.
