This Settlement Agreement is entered into as of the 1 day of October 2001, by and among Nathan Foote and Kenneth Lally (hereinafter “Settling Plaintiffs”), on behalf of the subclass members they represent, as more particularly described hereinbelow, the Michigan Attorney General, and Powercard International, Inc., d/b/a KM.Net (referred to herein as “PCI”). All of the parties to this agreement are referred to herein as “Settling Parties”.
