NON-EXCLUSIVE PATENT LICENSE THIS NON-EXCLUSIVE PATENT LICENSE (this “Agreement”) is entered into this 18th day of October, 2006 (the “Execution Date”), and shall be treated as in full force and effect as of July 1, 2006 (the “Effective Date”), by and between Palomar Medical Technologies, Inc., a Delaware corporation, with offices at 82 Cambridge Street, Burlington, MA 01803 (“Palomar”), and Laserscope, a California corporation with offices at 3070 Orchard Drive, San Jose, CA 95134-2011 (“Laserscope”) (Palomar on the one hand, and Laserscope together with all Laserscope Affiliates (as defined below) on the other hand, each a “Party”, and together, the “Parties”). WITNESSETH: WHEREAS, Palomar has a license from MGH under the Anderson Patents (both as defined below) relating to the use of light to remove hair; WHEREAS, Palomar and Laserscope are parties to that certain Patent License Agreement, dated October 15, 1999, as amended (the “Original Agreement”); WHEREAS, Palomar and Laserscope
