THIS AGREEMENT, made, effective as of February 9, 2015, by and among ETFis Series Trust I, a Delaware statutory trust (the “Trust”), on behalf of the InfraCap REIT Preferred ETF (the “Fund”), Etfis Capital LLC, a Delaware limited liability company (the “Adviser”) and Infrastructure Capital Advisors, LLC, a New York limited liability company (the “Sub-Adviser”).
