This Fund Participation Agreement (the “Agreement”), effective as of August 1, 2005, is made by and among Pacific Life & Annuity Company (“Company”), JPMorgan Investment Trust (the “Trust”), the Trust’s investment advisor, JPMorgan Investment Advisors Corporation (the “Adviser”), and the Trust’s administrator, JPMorgan Funds Management, Inc. (the “Administrator”).
