Contract Type FiledJanuary 22nd, 2010 Company IndustryLender by reason of foreclosure or other proceedings brought by it, or by deed in lieu of foreclosure or any other manner, the Lessee shall be bound to the Lender under all of the terms, covenants and conditions of the Lease for the balance of the term thereof remaining and any extensions or renewals thereof which may be effected in accordance with any option therefor in the Lease, with the same force and effect as if the Lender was the original lessor under the Lease. Lessee does hereby attorn to (a) the Lender as its landlord when the Lender is in possession of the Property, (b) a receiver appointed in any action or proceeding to foreclose the Deed of Trust, (c) any party acquiring title to the Property and (d) any successor to the Lessor; said attornment to be effective and self-operative without the execution of any further instruments on the part of any of the parties hereto immediately upon the Lender succeeding to the interest of the Lessor in the Property.
