THIS FIRST AMENDED AND RESTATED LEASE AND ACCESS AGREEMENT (EAST TULSA) (this “Lease”) is made and entered into to be effective as of 11:59 p.m. Dallas, Texas time on the 31st day of March, 2010, between HOLLY REFINING & MARKETING-TULSA LLC, a limited liability company organized and existing under the laws of Delaware (herein called “Lessor”), HEP TULSA LLC, a limited liability company organized and existing under the laws of Delaware (“HEP Tulsa”), and HOLLY ENERGY STORAGE-TULSA LLC, a limited liability company organized and existing under the laws of Delaware (“HEP Storage-Tulsa,” and collectively with HEP Tulsa, herein called “Lessees”).
