We refer to Biwater plc’s letter to Cascal N.V dated l5 October, 2009 and the Non-Compete, Confidentiality and Director Non-Removal Agreement (the Agreement) dated 3 January 2008, between Cascal B.V. (now Cascal N.V.) (Cascal) and Biwater plc (Biwater). Capitalised terms not defined in this letter have the meaning given to them in the Agreement. Clause 2 of the Agreement provides that Biwater will keep confidential any Confidential Information supplied to it by Cascal and will not disclose such Confidential Information without the prior written consent of Cascal.
