CREDIT AGREEMENT (as amended, modified, restated, supplemented and in effect from time to time, herein called this “Agreement”) dated as of August 31, 2005 (the “Effective Date”), among LUBY’S, INC., a Delaware corporation, the LENDERS party hereto, WELLS FARGO BANK, NATIONAL ASSOCIATION and AMEGY BANK, NATIONAL ASSOCIATION, as Documentation Agents, and JPMORGAN CHASE BANK, NATIONAL ASSOCIATION, as Administrative Agent for the Lenders.
