THIS LEASE AGREEMENT, (“Lease”) is made as of the 30th day of October, 2008 (the “Effective Date”), between Maguire Partners — Solana Limited Partnership, a Texas limited partnership (hereinafter called “Landlord”), and Middlebrook Pharmaceuticals, Inc., a Delaware corporation (hereinafter called “Tenant”).
