THIS LEASE TERMINATION AGREEMENT (this “Agreement”) is entered into as of this 29th day of April, 2009 (the “Execution Date”) , by and between BMR-LANDMARK AT EASTVIEW LLC, a Delaware limited liability company (“Landlord”), as successor-in-interest to Keren Limited Partnership (“Original Landlord”), and EMISPHERE TECHNOLOGIES, INC., a Delaware corporation (“Tenant”).
