This Trust Agreement (this “Agreement”) for the Abercrombie & Fitch Nonqualified Savings and Supplemental Retirement Plan, the Supplemental Executive Retirement Plan for Michael S. Jeffries and each and every other plan set forth on Exhibit A (each a “Plan” and collectively the “Plans”) made as of the 16th day of October, 2006 by and between Abercrombie & Fitch Co., a Delaware corporation (the “Company”), and Wilmington Trust Company (the “Trustee”).
