This FIXED RATE TERM LOAN AGREEMENT (this “Agreement”) is entered into as of October 1, 2008 by and among MISSION WEST PROPERTIES, L.P., MISSION WEST PROPERTIES, L.P. I, MISSION WEST PROPERTIES, L.P.
