This LICENSED PSP PUBLISHER AGREEMENT for the PlayStation Portable, (the “Agreement” or “ PSP LPA”), entered into as of the 15th day of September, 2004 (the “Effective Date”), by and between SONY COMPUTER ENTERTAINMENT AMERICA INC., with offices at 919 E. Tenant shall faithfully observe and comply with the following Rules and Regulations. Landlord shall not be responsible to Tenant for the nonperformance of any of said Rules and Regulations by or otherwise with respect to the acts or omissions of any other tenants or occupants of the Project. Landlord shall use reasonable efforts to cause other tenants or occupants of the Project to comply with the Rules and Regulations in order to avoid any unreasonable interference with Tenant’s use of the Premises as a result of the failure of such other tenants or occupants to comply with the Rules and Regulations. For purposes of this Lease, the Rules and Regulations of the Project, attached to and made a part of the Lease as Exhibit “D,” shall not be changed or revised or enforced in any unreasonable way by Landlord, nor enforced or changed by Landlord in such a way as to substantially interfere with Tenant’s rights under this Lease.
