This Separation and Release Agreement (the “Agreement”) is entered this 13th day of December, 2005 (the “Effective Date”) by and between Scott D. Jackson (“Employee”) and AFFORDABLE RESIDENTIAL COMMUNITIES INC., a Maryland corporation (“Parent”) and ARC MANAGEMENT SERVICES, INC., a Delaware corporation, on behalf of themselves and their affiliated entities (Parent and its affiliates collectively hereinafter sometimes referred to as “ARC”).
