THIS BNP ASSAY DEVELOPMENT, MANUFACTURE AND SUPPLY AGREEMENT (this “Agreement”) effective as of June 24, 2003 (the “Effective Date”), is entered into by and between BIOSITE INCORPORATED, a Delaware corporation (“Biosite”), having a place of business at 11030 Roselle Street, Suite D, San Diego, California 92121, and BECKMAN COULTER, INC., a Delaware corporation (“Beckman”), having a place of business at 4300 N.
