THIS EMPLOYMENT AGREEMENT (“Agreement”) is made on this 10th day of April, 2008 (the “Effective Date”), by and between AVI BioPharma, Inc., an Oregon corporation, with its principal office at 1 SW Columbia Street, Suite 1105, Portland, OR 97258 (“Company”), and Ryszard Kole, 203 Longwood Drive, Chapel Hill, NC 27514 (“Employee”).
