Affiliates shall have any liability to the undersigned Lender or its successors or assigns, and the undersigned Lender hereby, to the extent permitted by law, waives and releases any claims it may have against Company and its Affiliates with respect to the nondisclosure of the Excluded Information, now or in the future. The undersigned Lender agrees to include the foregoing acknowledgment and agreement in the definitive documentation for the purchase and sale of Term Loans contemplated by this letter.
