THIS AGREEMENT, made and entered into as of this 17th day of March , 2014 by and among Lincoln Life & Annuity Company of New York (the “Company”), a New York life insurance company, on its own behalf and on behalf of each of its segregated asset accounts named on Schedule A (the “Account”); FIRST TRUST VARIABLE INSURANCE TRUST, a business trust organized under the laws of the Commonwealth of Massachusetts (the “Fund”); and FIRST TRUST PORTFOLIOS, L.P., an Illinois limited partnership (the “Distributor”) (each a “Party,” and collectively, the “Parties”).

This Amendment to Fund Participation Agreement (the “Amendment”) is dated April 30, 2015, and is entered into by and among Lincoln Life & Annuity Company of New York, an Indiana insurance company (the “Company”), ALPS Variable Investment Trust, a Delaware Statutory Trust (the “Trust” or the “Fund,” and each series of the Trust listed on Exhibit B, as applicable, a “Portfolio” and collectively, the “Portfolios”), ALPS Advisors, Inc. a Colorado corporation, (“AAI”), and ALPS Portfolio Solutions Distributor, Inc. (“APSD”), a Colorado corporation.
