This Agreement, the Notes, the Guarantees, the Indenture, and the Dealer Manager Agreement, are collectively referred to herein as the “Transaction Documents” and the transactions contemplated hereby and thereby (including the Tender Offer and Existing Notes Satisfaction and Discharge) are collectively referred to herein as the “Transactions.”
