THIS AGREEMENT, made and entered into as of this 27th day of January, 2017, by and among THE LINCOLN NATIONAL LIFE INSURANCE COMPANY, an Indiana company (“LNL”) and LINCOLN LIFE & ANNUITY COMPANY OF NEW YORK a New York company (together with LNL, the “Company”),, on its own behalf and on behalf of its separate accounts (the “Accounts”); COLUMBIA FUNDS VARIABLE INSURANCE TRUST II, an open-end management investment company organized under the laws of Commonwealth of Massachusetts (the “Fund”); COLUMBIA MANAGEMENT INVESTMENT ADVISERS, LLC (the “Adviser”), a Minnesota limited liability company; and COLUMBIA MANAGEMENT INVESTMENT DISTRIBUTORS, INC. (the “Distributor”), a Delaware corporation.
