This Agreement is made as of the last date set forth on the signature page hereto (the “Effective Date”) between SOLARFUN POWER HONG KONG LIMITED, a company registered in Hong Kong (hereinafter “SOLARFUN”) and HOKU SCIENTIFIC, INC., a Delaware corporation (hereinafter “HOKU”). HOKU and SOLARFUN are sometimes referred to in the singular as a “Party” or in the plural as the “Parties”.

This First Amended & Restated Supply Agreement (“Agreement”) is made as of January 30, 2008 (the “Effective Date”) between SANYO Electric Co., Ltd. (hereinafter “SANYO”) and HOKU MATERIALS, INC. (hereinafter “HOKU”).

THIS AGREEMENT for the construction of Hoku electric substation and associated facilities (the “Agreement”) is entered into as of the 28th day of December, 2007 by and between HOKU MATERIALS, INC., One Hoku Way, Pocatello, Idaho 83204 (“Hoku”) and IDAHO POWER COMPANY, P.O. Box 70, Boise, Idaho 83707 (“Idaho Power” or “IPCO”). Hoku and IPCO may also be referred to hereinafter individually as “Party” or collectively as the “Parties”.
