This Amendment to the Custodian Agreement dated as of December 16, 2010 (this “Amendment”), is made and entered into by and among UNITED STATES COMMODITY FUNDS LLC, a Delaware limited liability company (the “Sponsor”), the UNITED STATES COMMODITY INDEX FUNDS TRUST, a Delaware statutory trust (the “Trust”), on its own behalf and on behalf of the UNITED STATES COMMODITY INDEX FUND, UNITED STATES METALS INDEX FUND, UNITED STATES AGRICULTURE INDEX FUND and UNITED STATES COPPER INDEX FUND (each, a “Fund”), and BROWN BROTHERS HARRIMAN & CO. You should review these statements to understand some of the risks of trading and be aware of how your rights in certain markets might be limited. These Statements should be kept by you and copies should be distributed to the relevant parties within your organization.
