This Engineering, Procurement and Construction Agreement (this “Agreement”) is made and entered into as of April 6, 2009, by and between NGP BLUE MOUNTAIN I LLC, a Delaware limited liability company (“OWNER”), and Industrial Builders (“CONTRACTOR”).
