Germantown Pike, Norristown, PA 19401 (“Auxilium”) and Oscient Pharmaceuticals Corp., a Massachusetts corporation, with principal offices at 1000 Winter Street, Suite 2200, Waltham, MA, 02451, (“Oscient”) (with each of Auxilium and Oscient referred to herein individually as a “Party” and collectively as the “Parties”).
