THIS EMPLOYMENT AGREEMENT (this “Agreement”) is entered into as of June 29, 2007 by and between Basin Water, Inc., a Delaware corporation (the “Company”), and Scott B. Hamilton (“Executive”), and shall be effective as of July 30, 2007 or such later date mutually agreed by the parties when Executive is able to commence full-time employment with the Company, but not later than August 15, 2007 (such date, the “Effective Date”).
