THIS LOAN AND SECURITY AGREEMENT (this “Agreement”) is made by and among MAP PHARMACEUTICALS, INC., a Delaware corporation (“Borrower”); OXFORD FINANCE CORPORATION, a Delaware corporation (“Oxford”) and SILICON VALLEY BANK, a California bank (“Silicon” and collectively with Oxford, “Lenders”).
