THIS COMMON STOCK PURCHASE AGREEMENT (this “Agreement”) is made and entered into effective as of August 18, 2008, by and among ODYSSEY MARINE EXPLORATION, INC., a Nevada corporation (the “Company”), and the investor(s) listed on the counterpart signature page(s) hereto, each of which is herein individually referred to as an “Investor” and all of which are herein collectively referred to as the “Investors.”
