This Employment Agreement (the “Agreement”), is retroactively effective as of January 9, 2012 (the “Effective Date”), and executed September 7, 2012, between Ampio Pharmaceuticals, Inc., a Delaware corporation headquartered at 5445 DTC Parkway, Suite 925, Greenwood Village, CO 80111 USA, hereinafter referred to as the “Company”), and Michael Macaluso “Employee”).
