I, James Miller (referenced herein as “I” or “me”), intending to be legally bound, agree to this Separation Agreement and General Release (the “Agreement”), which is being entered into between me and Landmark Apartment Trust, Inc. (formerly known as Landmark Apartment Trust of America, Inc., the “Employer”). For and in consideration of the mutual promises contained herein, and for other good and sufficient consideration, receipt of which is hereby acknowledged, the Employer and I (collectively, the “Parties”), intending to be legally bound, agree as follows:
