THIS AMENDED AND RESTATED EMPLOYMENT AGREEMENT (“Agreement”) dated as of June 30, 2013, amends and restates the Amended and Restated Employment Agreement, dated as of March 11, 2011, among Krispy Kreme Doughnut Corporation, a North Carolina corporation (“KKDC”), Krispy Kreme Doughnuts, Inc., a North Carolina corporation (the “Company” and, together with KKDC, the “Companies”), and James H. Morgan (the “Executive”).
