THIS LOAN AGREEMENT is made and entered into as of December 17, 2007, among CAPLEASE 2007-STL LLC, a Delaware limited liability company, as borrower (the “Borrower”), KBC BANK, N.V., a banking institution organized under the laws of the Kingdom of Belgium, acting through its New York Branch (in its individual capacity, “KBC”), a Belgium universal bank and each of the other financial institutions from time to time party hereto as lenders (collectively, the “Lenders”), and KBC, as administrative agent for the Lenders (in such capacity, together with its successors and assigns in such company, the “Administrative Agent”).
