THIS EXECUTIVE EMPLOYMENT AGREEMENT (“Agreement”) is effective as of the 12th day of October 2006 (“Commencement Date”) by and between HyperSpace Communications, Inc., a Colorado Corporation (the “Employer” or “Company”) and Michael R. Whyte (the “Executive”). In consideration of the mutual covenants contained in this Agreement, the Employer agrees to employ the Executive and the Executive agrees to be employed by the Employer upon the terms and conditions hereinafter set forth.
