THIS FEE WAIVER AGREEMENT (the “Agreement”) is entered into on August 29, 2023, by and between Tidal ETF Trust, a Delaware statutory trust (the “Trust”), on behalf of the Robinson Alternative Yield Pre-Merger SPAC ETF (the “Fund”), a series of the Trust, and Toroso Investments, LLC (the “Adviser”), the Fund’s investment adviser.
